Agreement

2.       Subject of Agreement                  

Ersbooking.com, is online reservation platform that markets and sells property rooms online. This platform consists of a web site provided for each property on a new address, web applications and sales portal at www.hoteladvisor.net.  

The aim is to integrally use property web, social media, mobile applications and B2B platforms to promote and sell its rooms to both customers and vendors (other travel agencies and online sales channels). 

Ersbooking.com is a platform that works in a membership model without taking commissions or other service fees from reservations. Instead payment is directly made to property. Hotel makes payment only to re-sellers (other travel agencies and sales channels), in form of commission, for the reservations they send through this platform. 

Through its web site and applications (web, Facebook and mobile), Ersbooking.com provides the following features :

1. Content management system easily used by hotel,

2. Private web address for the property,

3. Supports more than 40 languages and  89 currencies,

4. SSL technology,

5. Search engine optimization for the hotel name, address, features, photos etc., 

6. Online credit card processing,

7. Extra services and items sold together with reservations, 

8. It can work integrally with property management system (PMS),

9. It can be referred by the systems such as TripAdvisor, Trivago, etc.

10. It allows transfer of information to other online sales channels and can take reservations from them,

11. It is hosted by worlds safest servers (Microsoft AzureCloud Server or Amazon   Web Server),

12. It does not take commission or any charge per reservation,

13. Property can be in posses of all this advantages by the annual fee of 240,00 €.

This agreement is at the same time about use of HotelAdvisor. net platform and it regulates rights and obligations of thwo parties.  

3.       Rights and Obligations of Parties                  

 1. Property can update information (property's photos, texts, room prices etc.) on the ersbooking.com web site and portal with the given code and password.Property accepts responsibility for all the information written and published on the HotelAdvisor.net web page or portal and gives the HotelAdvisor.net full rights of using them in marketing and sales purpose. HotelAdvisor.net is allowed to use and share these information in written and visual form via web, mobile world and social media; publish informationon other sales channels; it can translate it to other languages; give the rights to business partners and other sales channels to use them in the same manner.  

2. Ersbooking.com does not take payments from the customer, instead, makes direct payment to property according to reservation terms. The Property can take the payment by virtual credit card processing system provided by HotelAdvisor.net or it can use credit card information as a guarantee for reservation and collect payment on spot. Customer are also able to choose the form of payment by his/her preferences.

In case when preferred method of payment is at hotel, for any problem that may arise related to credit cards (insufficient limit on the credit card at check-out, expire date or credit card's validity and similar) it is property's responsibility for the completion of payment. 

3. All reservations are received through HotelAdvisor.net according to availability, prices and conditions determined by the Property itself; payment or credit card information are taken online and transferred to property; therefore all reservations are guaranteed and will be considered automatically accepted by the Property. Property is not allowed to reject or cancel the reservations. If the Property is overbooked, it is obliged to provide customer with accommodation type of the same or higher star rating and cover all of the expenses including transfer, accommodation and similar.     

4. Ersbooking.com  will not be responsible for any customer complaint or compensation request regarding accommodation and reservations made through HotelAdvisor.net. Property accepts to proceed this type of requests by itself.  

5. In case of no show or cancellation made by customer, cancellation terms and conditions provided by Property for these cases will be valid. According to conditions, Property can take the certain percentage of first night or total reservation fee from the customer according to its previously defined cancellation policies. 

6. HotelAdvisor.net is system open to other sales channels and other online travel agencies. If the reservations are sent by these sales partners, Property accepts to pay them the commission rate determined in advance.

7. Hoteladvisor.net will not be party in any dispute that may arise from reservations made by ''sales partners'' through HotelAdvisor.net. In these cases, Property accepts to directly deal with '' sales partners'' to solve the problem. 

8. Property accepts responsibility for the use and protection of encoded credit card information according to the international PCI standards. 

9. Duration of agreement is one year. Each party is being able to cancel the agreement at any time in written notice. If it is not cancelled in written by the end of one year period this agreement will be automatically extended to one more year. 

10. Ersbooking.com is responsible for solving technical issues in the quickest and accurate possible manner. It certainly can not be held responsible for problems resulting from the unappropriate use of the system.   

11. This agreement is valid together with user terms provided at HotelAdvisor.net. By signing this contract both parties are considered to accept these terms.
